Student Sexual Misconduct Process
Members of the Ohio University community, including students, faculty, staff, and visitors, have the right to an environment free of sexual misconduct. University policy 03.004 defines sexual misconduct to include sexual acts that are committed against a person without their informed, knowing, and voluntary consent or committed when an individual is unable to freely give consent. Sexual misconduct and other acts of power-based personal violence are in conflict with the values of our community. Therefore, Ohio University does not tolerate sexual assault, sexual harassment, relationship violence, and stalking.
Under federal law, the Office of Equity and Civil Rights Compliance (ECRC) has a duty to prevent and redress sexual misconduct, including conducting investigations of all reports made to the office of sexual misconduct. All faculty and staff have been designated as "responsible employees," who must report all incidents of sexual misconduct of which they become aware. Some student-employees also have a duty to report sexual misconduct, including Resident Assistants, Teaching Assistants, and Graduate Assistants.
There are confidential resources available on campus and in the surrounding Athens community for individuals who may have been subjected to sexual misconduct that do not wish to file a formal report.
The Student Sexual Misconduct Resolution Process begins when ECRC receives a report that alleges sexual misconduct has occurred. That report can come from the individual subjected to the act of sexual misconduct or from a third party. ECRC works in conjunction with the Office of Community Standards and Student Responsibility (CSSR) to conduct investigations, assign conduct charges, and adjudicate findings in student sexual misconduct cases.
