General Statement

It is the policy of Ohio University to prohibit any and all solicitations or sales in Baker Center other than Baker Center operations or operations by a lessee or agent whose contract with the Center permits such solicitation or sale.

Definition of Terms

As defined for this policy statement the terms "solicitation" and "sales" shall mean any effort by an individual or an organization to (1) ask for, seek, bet, or entreat passersby to make a monetary contribution; (2) seek membership application from passersby to any organization not recognized by Ohio University; or (3) offer for sale any item, symbol, product, or service whether or not there is an actual on the spot monetary transaction.

Approvals of Waivers

Approvals of contracts or waivers of this policy shall be made only by the Director of Student Life Programs.

Contracts

Contracts with vendors, other than recognized student organizations or local craftsmen, and for a short term period (1 to 10 days) shall include all or any part of the following:

  1. Dates and times of sale.
  2. Statement of number of tables, chairs, and/or other materials to be supplied by Baker Center.
  3. Location restrictions (Baker Center lobby, second floor gallery, or ground floor corridor).
  4. Commission to Baker Center with a minimum of 10% of gross sales.
  5. Stipulation that vendor must hire and pay Baker Center cashiers at their current rate of 10¢ per hour over the federal minimum wage.
  6. Statement that all daily receipts shall be deposited in the Baker Center Assistant to the Director's office following the closing of each day's sale.
  7. Agreement that Baker Center Assistant to the Director's office will total daily receipts, deduct percentage due Baker Center and cashiers, and present to vendor the following business day a statement of transactions and net receipts.
  8. Any advertising or publicity restrictions deemed appropriate by Baker Center.
  9. Requirement of a security deposit.
  10. Statement that conduct shall be governed by Athens City, Ohio University and Baker Center rules and regulations.

Contracts with local craftsmen or Ohio University recognized student organizations for the purpose of displaying and selling their wares shall include all or any part of the following:

  1. Dates and times of sale - not to exceed six calendar days and limited to the hours between 8:00 a.m. and 6:00 p.m.

  2. Statement of number of tables, chairs, and/or other materials to be supplied by Baker Center.
  3. Location restrictions (Baker Center lobby, second floor gallery, or ground floor corridor).
  4. Rent requirements for use of facility.
    A. 1-3 days - $5.00
    B. Each additional day - $2.00
  5. Any advertising or publicity restrictions.
  6. Statement that conduct shall be governed by Athens City, Ohio University and Baker Center rules and regulations.

Exceptions

The above policy shall not be construed to prohibit the membership drives and organizational activities, including sales, conducted by recognized Ohio University organizations. Permission for such activities will be granted by the Director of Student Life Programs office on a first-come, first-served basis. These activities will normally be conducted in the main lobby of the Center. Organizations using facilities of the Center for these activities must identify themselves by names displayed in a prominent place.

Violations

Violation of the above policies will result in withdrawal of permission to conduct activities in the Center and/or action through the Ohio University civil or judicial systems.
